A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the court noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
